Frequently Asked Questions (NRI Tax Knowledge Base)

Does an NRI have to file an income tax return in India?

Yes. An NRI may be required to file an Income Tax Return (ITR) in India where the applicable filing conditions are satisfied. The applicable provisions depend on the relevant tax year and whether the Income-tax Act, 1961 or Income-tax Act, 2025 governs the matter.

What is the TDS rate when an NRI sells property in Mumbai?

When an NRI sells property in India, the buyer may be required to deduct TDS under Section 393(2) of the Income-tax Act, 2025 for transactions governed by the new Act. For earlier periods, Section 195 of the Income-tax Act, 1961 applies. The applicable rate depends on the nature of the income, the asset, the relevant tax provisions, and any applicable DTAA. A lower or nil deduction certificate may be available under Section 395(1) of the Income-tax Act, 2025 through Form 128 where the prescribed conditions are satisfied.

How can an NRI repatriate money from an Indian property sale overseas?

NRIs may repatriate eligible funds subject to applicable RBI and FEMA requirements. For tax compliance relating to remittances made on or after 1 April 2026, Form 145 and Form 146 under the Income-tax Act, 2025 replace Forms 15CA and 15CB used under the earlier framework, subject to the applicable conditions and thresholds.

What is the difference between NRI Taxation rules and DTAA benefits?

Domestic NRI taxation rules govern how India taxes income under the applicable Income-tax law. A Double Taxation Avoidance Agreement (DTAA) is a bilateral treaty between India and another country that may provide relief from double taxation through applicable tax rates, exemptions, or foreign tax credits, subject to the treaty's conditions and documentation requirements such as a Tax Residency Certificate (TRC) and, where applicable, Form 10F.
